Right of Withdrawal

Download as PDFThis policy applies to consumers, meaning natural persons who place an order for purposes that are predominantly outside their trade, business or profession. Please note: we manufacture every part to your specification, so no item in our current range carries a right of withdrawal under section 312g(2)(1) BGB. The withdrawal policy below applies only where, by way of exception, an order line does carry one. This English text is a courtesy translation; the German version is the legally binding one.
No right of withdrawal for parts made to your specification
Under section 312g(2)(1) BGB there is no right of withdrawal for contracts covering goods that are not prefabricated and are made on the basis of an individual choice or decision by the consumer, or that are clearly tailored to the consumer's personal requirements.
We hold no prefabricated stock. Every part is cut for your individual order from the material you selected, in the thickness, finish and geometry you selected, and manufacture only begins once your order has been received. This applies to parts we make from design data you uploaded or created in the browser, and equally to parts you configure from one of our parametric templates: the template is the starting point for your specification, not a stock article.
No item in our current range therefore carries a right of withdrawal. We point this out to you before you submit your order.
Your statutory rights in respect of defective parts remain unaffected in any case; Section 12 of our Terms and Conditions covers those rights.
Right of withdrawal
Where, by way of exception, an order line does carry a right of withdrawal under the section above, the following applies to that line:
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods. If you ordered several goods in a single order that are delivered separately, the withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the last item. If goods are delivered in several partial shipments or pieces, the withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the last partial shipment or piece.
To exercise the right of withdrawal, you must inform us (Dynamic Parts GmbH, Max-Eyth-Str. 8, 72348 Rosenfeld, Germany, phone: +49 15679 830679, email: info@dynamicparts.eu) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us (Dynamic Parts GmbH, Max-Eyth-Str. 8, 72348 Rosenfeld, Germany) without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
